Dow Chemical Co. has asked the 10th Circuit Appeals Court in Denver to think again about its decision to reject Dow’s appeal against a $1.1 billion fine for price fixing.

Dow’s lawyers have gone back to the court to ask it to reconsider its latest verdict, on the basis that it conflicts with case law developed by the US Supreme Court on class actions, according to a report on Law 360.

Midland, Mich.-based Dow Chemical has asked all of the judges in the court to hear the case, rather than the panel of three judges, Lucero, Murphy and Bacharach who tried and rejected Dow’s appeal.

Court documents show that the other parties involved have until Oct. 24 to respond.
